A patent application can be filed either by first inventor or his assignee. However, legal representative of any deceased person can also apply for a patent.
The patent registration is valid for a period of 20 years from the date of filing.
Patent protection is a territorial right and hence it is applicable within India. However, filing an application in India enables the applicant to file a corresponding application for same invention within or before expiry of 12 months from the date of filing.
