India’s New Labour Codes: What Your Business Needs to Know

For a long time, labour law compliance in India meant dealing with 29 different laws. Different rules, different forms, different deadlines — often overlapping and confusing. For business owners, especially small and mid-sized ones, keeping up was a real challenge. For workers, the protections weren’t always consistent or fair.

To fix this, the Government of India introduced four new Labour Codes between 2019 and 2020 — bringing all 29 laws under one roof.

The Four Labour Codes

  • Code on Wages, 2019 — covers all employees across every industry
  • Industrial Relations Code, 2020 — covers trade unions, disputes, and employment conditions
  • Code on Social Security, 2020 — extends PF, gratuity, and insurance to all workers including gig workers
  • Occupational Safety, Health and Working Conditions Code, 2020 — applies to factories, mines, and establishments with 10 or more workers

What Actually Changed?

  • No mandatory appointment letters before — now every worker must receive one.
  • Minimum wages earlier covered only certain industries — now it applies to all workers, with timely payment being a legal obligation.
  • Gig and platform workers had zero social security — now they’re covered under PF, ESIC, and insurance.
  • ESIC was limited to specific areas — now it’s pan-India, even for a single worker in a hazardous setup.
  • Women had restrictions on night shifts — now they can work all jobs and shifts with proper consent and safety measures.
  • Multiple registrations and returns — now replaced with a single registration and return, nationwide.
  • Employers must now provide free annual health check-ups for workers above 40.

What This Means by Sector

  • Retail — Appointment letters, minimum wage compliance, defined working hours, women permitted in night shifts with safety protocols. Establishments with 50 or more employees must provide crèche facilities.
  • Hospitals — Safe working conditions, protective equipment, health check-ups for staff, duty-hour regulations for doctors and nurses, and ESIC coverage for all medical staff including contractual workers.
  • Warehousing — Fire safety, ventilation, accident prevention under the Occupational Safety Code. Appointment letters and wage transparency for loaders and packers. Gig workers in logistics now covered under Social Security.
  • Across All Industries — Single registration and return filing, and mandatory internal committees for prevention of sexual harassment (POSH Act compliance).
